[edit]Noun
[edit]Rahmenrecht n (strong, genitive Rahmenrechtes or Rahmenrechts, plural Rahmenrechte)
- legal framework, a collection of statutes determining the limits of an activity
- (Germany)[n 1] an absolute right which has a large scope of protection but the unlawfulness of an interference with it is not indicated by the mere transgression but it must be particularly qualified as it must be positively asserted by weighing the conflicting rights, legally protected assets and interests
- Hypernyms: sonstiges Recht, sonstiges absolutes Recht
- Hyponyms: allgemeines Persönlichkeitsrecht, Recht am eingerichteten und ausgeübten Gewerbebetrieb (there are only two thereof accepted in the FRG)
Usage notes
[edit]- ^ Unlike in German law where such a term is motivated by these rights not being mentioned in § 823 Abs. 1 BGB but subsumed under “other right”,
- in Switzerland one has pursuant to Art. 28 ZGB a claim against interferences with a personality right without outweighing interest.
- In Austria tort goes more general in the first place after § 1295 ABGB, not restricted by affected rights.
